Environmental Claims, Insurance Coverage and Surety
 

 Avalon Associates - In the first New Jersey case to decide that ground water belonged to the state, attorneys in the firm successfully obtained insurance coverage for a real estate owner sued under various environmental statutes including the New Jersey Spill Compensation and Control Act, the New Jersey Water Pollution Control Act, and the New Jersey Underground Storage of Hazardous Substances Act.
 
Centennial Square - We represented a contractor sued under the Spill Act after accidentally rupturing a 14" gasoline line.  The firm also handled related insurance coverage litigation and claims against the broker.
 
Round Valley Reservoir - We brought a successful declaratory judgment action on behalf of a New Jersey contractor obtaining coverage from its general liability carriers sufficient to cover defense costs and the settlement amount in an action brought by the New Jersey Water Supply Commission seeking damages for a defective release line.
 
City of Paterson - We were retained by Paterson to present it in litigation in which it had been named as a Potentially Responsible Party with respect to alleged landfill pollution.
 
Tampa Int'l Airport - Attorneys in the firm brought suit in Georgia and obtained coverage from a contractor's general liability carrier for claims of the airport authority arising out of a defective runway.
 
Georgia Dept. of Transportation - In a case ultimately heard by the Georgia Supreme Court and the Eleventh Circuit Court of Appeals, attorneys in the firm successfully brought suit against a surety company to obtain coverage under the bond even though the principal had released the obligee without consent of the surety.
